The Imports and Exports (Control) Act, 1950 343 (b) “Collector of Customs” means an officer appointed as such under 1[section 3] of the Customs Act, 1969 (IV of 1969); and (c) “import” and “export” mean respectively bringing into, . h and taking out of, Bangladesh by sea, land or air. s e d a 3. (1) The Government may, by order published in the Powers to gl prohibit or official Gazette and subject to such conditions and exceptions n restrict iamports as may be made by or under the order, prohibit, restrict or and ex B ports otherwise control the import or export of goods of any specified s , r description, or regulate generally all practices (including trade ai practices) and procedure connected with the import or export of f f A such goods, and such order may provide for applications f or y r licences under this Act, the evidences to be attached toa such t applications, the grant, use, transfer, sale or cancellationn of such e licences, and the form and manner in which andm the periods within which appeals and applications for revieaw or revision may be preferred and disposed of, and the chaarr l g i ing of fees in P respect of any such matter as may be provided in such order. d n a (2) No goods of the specified des cription shall be imported e or exported except in accordancce with the conditions of a ti licence to be issued by the Chiesf Controller or any other officer u authorised in this behalf by thJe Government. w , (3) All goods to w a hich any order under sub-section (1) L applies shall be deefm ed to be goods of which the import or o export has been yp rohibited or restricted under section 16 of the r Customs Act, 1t969 (IV of 1969), and all the provisions of that s Act shall hanv i e effect accordingly. Mi (@4) Notwithstanding anything contained in the aforesaid Actt the Government may, by order published in the official h gGazette, prohibit, restrict or impose conditions on the clearance ri ywhether for home consumption or ware-housing or shipment p o abroad of any imported goods or class of goods. All orders made under section 3 of the Imports and existing orders Exports (Control) Act, 1947, and in force immediately before the commencement of this Act, shall so far as they are not inconsistent with the provisions of this Act, continue in force and shall be deemed to have been made under this Act. . h s Prohibition to 1[4A. No person shall sell, purchase or otherwise deal in e d sell or purchase any import licence other than an import licence issued under thae import licence Export Bonus Scheme. gl n a Explanation.- In this section “Export Bonus BScheme” means the scheme introduced by Government 2[* * *,] . s ai r Prohibition 4B. Except with the previous permission in writing of the f f regarding sale Chief Controller or any other officer authorAised in this behalf and transfer of by the Government, no person who in his yca pacity as industrial goods by consumer, imports any goods against a laic r ence issued to him or, industrial where no licence is required for the imnp t ort of such goods by an consumer e industrial consumer, without any mlicence, shall sell or otherwise transfer such goods or use the agoods for a purpose other than the purpose or purposes for rwli hich the licence was issued or a such goods were imported.P] d Penalty 5. If any person cnontravenes any provision of this Act or a any order made or d eemed to have been made under this Act or e the rules made thcereunder, or makes use of an import or export licence otherwsisti e than in accordance with any condition in that u behalf impoJsed under this Act, he shall without prejudice to any confiscati,o n or penalty to which he may be liable under the w provisaions of the Customs Act, 1969 (IV of 1969), as applied by sLub-section (3) of section 3 of this Act be punishable with imopfrisonment for a term which may extend to one year, or with yfine, or with both. r s t Cognizance nofi 6.
